JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 307 and other allied Sections of the Indian Penal Code. Petitioner is said to have opened fire causing fire arm injury to injured Randhir Paswan, but learned counsel for the petitioner drew my attention towards Annexure-3 series and points out that no fire arm injury was found on the person of the injured Randhir Paswan and the doctor opined that the injury found on the person of the injured Randhir Paswan was simple in nature caused by hard and blunt substance. Moreover, there is counter case in which it is alleged that it was prosecution party, who assaulted the informant of the counter case and others.

No.14738 of 2016 (2) dt.08-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Nalanda at Biharsharif in connection with Sare P.S. Case No.38 of 2015.
