The petitioner seeks bail in Kochadhaman P. S. Case No. 24 of 2018 instituted for the offence under Section(s) 21/22 of the N.D.P. S Act.

In the written report, it is alleged that informant during patrolling duty got information that one vehicle after meeting with an accident is standing near the tyre repairing shop of Md. Samshad for the last 2-3 days. The informant went to that place and did not find driver or owner of the alleged vehicle. The informant found the vehicle had met with an accident. It is alleged that on search of the vehicle 150 kg of ganja was recovered.

The petitioner has been made accused in this case

Patna High Court Cr.Misc. No.5108 of 2019(2) dt.31-01-2019 2/2 because he is owner of the aforesaid vehicle. Learned counsel for petitioner submits that from the written report itself it would appear that petitioner was not present on the spot. The vehicle had met with an accident and it was lying at the place of occurrence in abandoned condition for last 2-3 days.

The petitioner is in custody since 31.10.2018 having clean antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum- Special Judge, Kishanganj, in connection with Kochadhaman P. S. Case No. 24 of 2018, Spl. Case no. 5/2018 subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
