From the memo of appeal it transpires that this appeal has arisen out of a suit for partition, in which respondent nos. 2 and 3 were plaintiffs and respondent nos. 4 and 5 were defendants.

Patna High Court SA No.380 of 1988 (8) dt.18-02-2015 5, proceeding further in this appeal may result in chances of conflicting decrees and orders and as such this appeal is dismissed as incompetent.
