The petitioners are apprehending their arrest in connection with Makhdumpur P.S. Case No. 453 of 2019 registered for the offences punishable under Sections 147/148/149/341/323/307/302/427/379/504 of the Indian Penal Code.

Allegation of commission of assault is against 18 FIR named and 10 to 15 unknown persons. The assault resulted in death of the injured.

Learned counsel for the petitioners submits that considering the general and omnibus nature of allegation some of the co-accused were allowed regular bail by a coordinate

Patna High Court CR. MISC. No.3544 of 2020(4) dt.16-10-2020 2/2 Bench of this Court and in the matter of some other co-accused who had approached this Court for anticipatory bail in Cr. Misc. No.84418 of 2019 direction was made to the Court-below to consider prayer for regular bail in the light of grant of regular bail to some other co-accused.

Considering the submission aforesaid, this Court is not inclined to allow the petitioner on anticipatory bail. However, the Court-below shall consider the prayer for regular bail on the basis of grant of regular bail to other similarly situated co-accused.

With the aforesaid observation, this application stands disposed of.
