JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 The petitioners are languishing in custody since 05.04.2015 in connection with Nimchak Bathani P.S. Case No. 56 of 2015 for the offences instituted under Sections 370/34 of the I.P.C.

Heard learned counsel for the petitioners and learned counsel for the State.

The prosecution story, in brief, is that in course of patrolling at about 3.30 P.M., received secret information that two persons were carrying two numbers of minor boys in a Tavera vehicle which has been stripped by local persons near village Simraha. The informant thereupon arrived and found a crowd near the vehicle. Thereafter the villagers told that on seeing the vehicle

Patna High Court Cr.Misc. No.25031 of 2015 (2) dt.20-07-2015 2/2 carrying the minor boys they transpired that both the boys were being carried for recruitment in some illegal business. The informant also made enquiry and those major persons disclosed their name and their address. On being asked the minor boys told that those persons induced them for giving money for engagement in some illegal business.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 05.04.2015. It is further submitted that vide annexure-2 to the supplementary affidavit which has been filed on behalf of the father of the victims stating that he on his own had sent the victims alongwith the petitioners. It is further submitted that the victim boys have been released in favour of the father.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya, in connection with Nimchak Bathani P.S.
