JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.
Petitioner happens to be maternal uncle of Vikash Kumar and admittedly, the name of petitioner surfaced in this case in course of investigation when the dead body of the deceased was recovered from a lonely place and the witnesses claimed that deceased was taken to the house of co-accused Upendra Rai who happens to be full brother of the petitioner and thereafter, the deceased was killed there and her dead body was thrown at lonely place. Moreover, co-accused Upendra Rai
Patna High Court CR. MISC. No.3346 of 2019(3) dt.28-03-2019 2/2 has already been admitted to bail by a co-ordinate Bench of this court vide order dated 20.12.2018 passed in Cr. Misc. No. 76661 of 2018. There appears to be nothing specific against the petitioner in the case diary.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Dalsingsarai, Samastipur in connection with Ujiarpur P.S. Case No. 28 of 2015.
