Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Unchakagaon P.S. Case No. 489 of 2022 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act 2022.

Learned counsel for the petitioner submits that the petitioner is in custody since 19.12.2022 and there is recovery of 369 liters of country made and foreign made liquor. Petitioner is the driver of the vehicle from which the recovery was made and not the owner.

Learned A.P.P. has vehemently opposed the prayer for

Patna High Court CR. MISC. No.6171 of 2023(2) dt.03-05-2023 2/2 2023 bail.

Considering the period of custody and the recovery of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Session Judge-II-cum-Special Judge ExciseI, Gopalganj in connection with Unchakagaon P.S. Case No. 489/2022.
