====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 03-03-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application with regard to petitioner No. 5.

2. Permission is granted.

3. The anticipatory bail application with regard to petitioner No. 5 is, accordingly, dismissed as withdrawn.

4. Heard learned counsel for the petitioners and the State.

5. Petitioner Nos. 1 to 4 apprehend arrest in a case

Patna High Court CR. MISC. No.7765 of 2025(2) dt.03-03-2025 2/3 registered for the offences punishable under Sections 147, 148, 149, 323, 385, 379, 427, 504 of the Indian Penal Code and Section 27 of the Arms Act.

6. As per prosecution case, on the alleged date and time of occurrence, all the F.I.R. named accused persons including these petitioners, armed with deadly weapons, attacked informant and damaged trucks and also snatched Rs. 8100/-. It is further alleged that the accused persons also demanded ransom of Rs. 5 lacs.

7. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. As a matter of fact, petitioners are local agriculturist and were protesting against illegal work of informant/contractor. Petitioners have also filed an informatory petition No. 1665 of 2024 on behalf of the villagers against the informant along with several other applications before different forums for taking serious action against the informant. Petitioners claim clean antecedent.

8. Learned A.P.P. for the State vehemently opposed the bail application.

9. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner Nos. 1 to 4 in the event of their

No.7765 of 2025(2) dt.03-03-2025 3/3 arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Gaya in connection with Panchanpur P. S. Case No. 59 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
