JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. Petitioner is not named in the first information report but from perusal of the impugned order, I find that the name of petitioner came in confessional statement of co-accused, Monu Dobey @ Rasul, whose photograph was caught by CCTV camera and except the aforesaid confessional statement as well as criminal antecedent of the petitioner, there appears to be nothing against him. Petitioner is in jail custody since 08.02.2016 and it appears that up till now, he has not been put on Test Identification Parade. Moreover, one co-accused, Md. Salim, having more or less similar

Patna High Court Cr.Misc. No.15644 of 2016 (2) dt.19-04-2016 2/2 allegation, has already been granted privilege of bail by the learned Sessions Judge itself.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in connection with Katihar Town P.S. Case No. 794 of 2015.
