====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 26-02-2019 In view of the fact that the petitioner no.1 has already been arrested by the police, this order is confined to the petitioner no.2 only.

Heard learned counsel for the petitioner and learned counsel for the State as also counsel for the Informant. In this case, the petitioner is apprehending his arrest in connection with Kargahar P.S. Case No. 382 of 2018 registered for offences under sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

An allegation has been made that the co-accused Bashishth Prasad and the petitioner followed the Informant and, from the 1st floor, he was thrown on the ground and, after that,

There being specific allegation against the petitioner, Nishant Prasad @ Chhote @ Nishant Kumar, this Court is not inclined to grant privilege of anticipatory bail to him. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.

If the petitioner surrenders before the court below within a period of three weeks from today and prays for bail, the court below, without being prejudiced by this order, will pass orders in accordance with law..
