The petitioner is languishing in custody since 13.04.2015 in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

On theft of the Bolero vehicle of the informant the FIR was lodged against unknown. During investigation the name of the petitioner sprang up on the confession of co-accused.

It is submitted by learned counsel for the petitioner that the there is no recovery from the petitioner and the investigation has already concluded.

No.24274 of 2015 (2) dt.20-07-2015 2/2 Considering the fact that the investigation has already concluded and the recovery has not been made from the petitioner, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 65 of 2015.

Since the petitioner is accused in three other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults for two consecutive occasions or substantially gets involved in some serious nature of offence.
