JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-01-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Bihar P.S. Case No. 126 of 2020, registered for the offences punishable under Sections 366(A) of the Indian Penal Code. The informant, Sunita Devi is the mother of the victim. As per allegation her daughter went to appear in examination but she did not return. The petitioner told the informant on phone that he is taking her daughter to Delhi. The informant expressed her belief that the present petitioner with some evil intent kidnapped her daughter. The statement of the daughter of the informant was recorded under Section 164 of the Cr.P.C. She has stated in her

Patna High Court CR. MISC. No.15463 of 2021(2) dt.17-01-2022 2/2 statement that her preparation for examination was not well it was the reason that she did not participate in the examination. She has further stated that none has taken her by force rather she went with her own sweet will.

Considering the above-mentioned facts and circumstances, let the petitioner be released on anticipatory bail in the event of his arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda (Biharsharif) in connection with Bihar P.S. Case No. 126 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
