The petitioner is languishing in custody since 4.8.2018 in a case registered for the offences punishable under Sections 25(1B)a,26 and 35 of the Arms Act. The prosecution case is that one country made rifle and one live cartridge were recovered from beneath the bed of the petitioner.

It is submitted by learned counsel for the petitioner that the recovery has been made from the joint family house and the petitioner is in custody since 4.8.2018. It is further submitted that though the petitioner is accused in two other cases, but he is on bail in those cases.

Considering the nature of recovery and the period of custody, let the petitioner above named be released on bail on

Patna High Court Cr.Misc. No.2107 of 2019(2) dt.16-01-2019 2/2 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM Ist Class, Danapur in connection with Rani Talab P.S. Case No.208 of 2018.

Since the petitioner is having criminal antecedent, the learned Court below will be at liberty to cancel the bail bonds of the petitioner in case he subsequently gets involved in similar nature of offence.
