The petitioner seeks regular bail in Wazirganj P.S. Case No. 108/2017, registered for the offences punishable under Section 302 and 34 of the Indian Penal Code.
It is alleged in the written report that petitioner along with other accused persons after entering into the house assaulted the mother of informant with Chaku, Pasuli etc. on account of which she died. Postmortem report is annexed as Annexure-2 which shows that Doctor has opined that injuries were ante mortem caused by hard and blunt substance. Other co-accused with similar allegation have been granted bail vide order dated 09.10.2017 passed in Cr. Misc. No. 44324/2017, order dated 03.07.2018 passed in Cr. Misc. No. 30255/2018 and
Patna High Court Cr.Misc. No.3536 of 2019(2) dt.01-02-2019 2/2 order dated 06.10.2018 passed in Cr. Misc. No. 61220/2018. Learned counsel for the petitioner has submitted that there is general and omnibus allegation against petitioner in the written report. Petitioner is in custody since 16.07.2018 having clean antecedent.
Considering the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Gaya in connection with Wazirganj P.S. Case No. 108/2017, subject to the condition that both the bailors will be close relative of the petitioner.
