The petitioner is in custody in connection with S.T. No. 570 of 2011 arising from Masaurhi P.S. Case No. 46 of 2009 registered for offence punishable under Sections 302, 225 and 34 of the Indian Penal Code.
The charge against the petitioner is of slashing the neck of the daughter of the informant causing her death and it is taking note of the nature of allegation that the prayer of bail was earlier rejected on 12.03.2012 vide order passed in Criminal Misc. No. 31041 of 2011 and has been renewed through the present application. The order of the court below manifests that of the prosecution witnesses, eight have been examined and only the Investigating Officer and the Doctor are left to be examined.
Patna High Court Cr.Misc. No.24391 of 2015 (2) dt.24-06-2015 In the circumstances, no case for indulgence is made out and this application is dismissed.
Since only two witnesses i.e. Investigating Officer and the Doctor are left to be examined, the trial court would be well advised to conclude the trial expeditiously.
