The petitioner has renewed his prayer for bail in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.

It is alleged that the petitioner along with Dharmendra Singh, Arun Singh @ Khikhar Singh, Anil Kumar @ Makharu Singh and Shatrughan Paswan came to the house of the informant for the purpose of compromising the earlier case when they took the brother of the informant since then he is traceless

Patna High Court Cr.Misc. No.24370 of 2014 (04) dt.18-03-2015 2/3 when it is suspected that the petitioner and others killed the brother of the informant.

It is submitted by learned counsel for the petitioner that there is no direct evidence against the petitioner whereas main accused Arun Singh @ Khikhar Singh has been granted bail vide Cr. Misc. No. 5951 of 2014 and Dharmendra Singh vide Cr. Misc. No. 46183 of 2014.

The petitioner's earlier prayer for bail was rejected since he was involved in eight other cases. The report of the learned Ad hoc Additional Sessions Judge-II, Lakhisarai dated 16.02.2015 reflects that the charges were framed on 14.11.2014 but no witness has been examined.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge-II, Lakhisarai in connection with Sessions Trial No. 822 of 2013 arising out of Lakhisarai P.S. Case No. 568 of 2009. Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in
