JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307/34 of the Indian Penal Code.
Petitioner is not named in the first information report and admittedly, petitioner is co-villager of the informant. No doubt, the informant claims in his ferdbeyan that one Karmveer along with a boy of his village assaulted him but admittedly, the informant did not disclose the name of his co-villager rather stated that he could identify the aforesaid unknown person but subsequently, in course of investigation, the informant disclosed
Patna High Court Cr.Misc. No.15640 of 2016 (2) dt.19-04-2016 2/2 the name of the petitioner and accordingly, petitioner has been dragged in this case.
Learned counsel for the petitioner points out that coaccused, Karmveer has already been granted privilege of bail by a co-ordinate Bench of this court.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Lakhisarai in connection with Mednichowki P.S. Case No. 83 of 2014.
