JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioners are languishing in custody since 01.04.2015 in connection with Mairwa P.S. Case No. 48 of 2015 for the offences instituted under Sections 147, 148, 149, 341, 323 and 307 of the I.P.C.
Heard learned counsel for the petitioners and learned counsel for the State.
The prosecution story, in brief, is that on 30.03.2015 at 18.30 in the evening the informant, Ajay Kumar Gond, aged about 19 years, was laughing and joking with his cousin, Jitendra Kumar Gond near his house, in the meantime, Nijammudin Ansari came and abused them. The informant prohibited him. Thereafter, other accused persons came with Lathi, Danda, Knife, Dab and assaulted them. Sarfuddin Ansari gave knife blow on the head of
Patna High Court Cr.Misc. No.24111 of 2015 (2) dt.06-07-2015 2/2 the informant and Nizammmuddin Ansari stabbed in the stomach of cousin of the informant.
It has been submitted on behalf of the petitioners that both the petitioners are alleged to have given knife blows. No repeated blows are said to have been made by the petitioners. It is further submitted that the petitioners had no intention to commit murder of the informant or others who are said to have been injured in course of occurrence. It is further submitted that the petitioners are in custody since 01.04.2015. It is further submitted that the petitioners may be released on bail after completion of six months in custody.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail after completion of six months in custody from 01.04.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, in connection with Mairwa P.S.
