JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 302, 364 and 201/34 of the Indian Penal Code. Petitioners are named in the first information report as informant claimed that his son gave information to him on his phone that petitioners and other F.I.R. named accused had caught him and the son of informant was crying for help. Having got the aforesaid information, the informant went in search of his son, but on the next day, the body of the informant's son was recovered. The impugned order shows that almost all the witnesses have supported the above stated fact and not a single witness came forward to claim himself to be an eye witness of the case.
Patna High Court Cr.Misc. No.14966 of 2016 (2) dt.11-04-2016 2/2 Moreover, co-accused Lohar Paswan, having more or less similar allegation, has already been granted privilege of bail by a Coordinate Bench of this Court. The investigation of the case has already been completed.
Accordingly, petitioners above named are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Aurangabad in connection with Raffiganj P.S. Case No.75 of 2015.
