JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was caught in a room of hotel along with Nilam Devi, whose statement was recorded under section 164 of the Cr.P.C and in the said statement, she stated that petitioner being her brother-in-law took her in a hotel when she complained about her headache and while she was taking rest in the room of hotel, police reached there and caught her as well as the petitioner. The name of the petitioner has been shown as Munshi Ram in the first information report but submission on behalf of the petitioner is that the police wrote the wrong name of the petitioner though petitioner had disclosed his correct name before the police. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact
