The petitioner is languishing in custody since 06.11.2014 in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The prosecution case is that the widow daughter of the informant was killed by her in-laws family members for grabbing the share of the husband of the victim. It is submitted by learned counsel for the petitioner that admittedly there is no eye witness to the occurrence and only on suspicion the petitioner has been roped in as the petitioner happens to be the aunt of the late husband of the victim.

Considering the circumstantial nature of accusation, investigation being concluded and petitioner being a lady, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Ghorasahan (Jitna) P.S.
