The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 448, 323, 324, 307, 504 & 506 of the Indian Penal Code. The accusation is that when the informant was constructing the boundary wall on her land, petitioner along with other accused persons came and broke her wall. When she forbade them Md. Alim by using brick bat injured her. They also broke her husband right hand by rod. When her matrnal nephew Irphan rushed to rescue them they also assaulted him inflicting injury on his head.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place.

There is land dispute between the parties for which an altercation took place and petitioner's side lodged Keoti P.S. Case No.125 of 2019 against the informant's side and to save skin from the aforesaid case this false and frivolous case has been lodged against the petitioner and others. The injury sustained by the victims are simple in nature. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VII, Darbhanga in connection with Keoti P.S. Case No. 126 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
