JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-03-2019 The petitioner apprehends his arrest in connection with Baisi P.S.Case No. 241 of 2018 arising out of Special Excise Case No. 849 of 2018 registered under Sections 272 and 273 of the Indian penal Code and 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 15 litres bear and 13.90 litres of foreign liquor from a vehicle and petitioner is named in the FIR.

Submission of learned counsel for the petitioner is that he is a driver having no criminal antecedent and he has nothing to do with the seized articles.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed,

Patna High Court CR. MISC. No.3962 of 2019(3) dt.08-03-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge-cum-Special Judge, Excise, Purnea in connection with Baisi P.S.Case No. 241 of 2018 arising out of Special Excise Case No. 849 of 2018 ; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
