JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report with allegation that they as well as other co-accused assaulted the informant and others. Altogether four persons sustained injuries in the alleged occurrence and out of the aforesaid four persons, three injured sustained simple injuries. So far as informant is concerned, he sustained two injuries, one is on his scalp and another is on his right thigh.

The opinion regarding the nature of the injuries of the informant was kept reserved and it appears from the impugned order that till the date of passing of the impugned order, the prosecution could not produce complete injury report of the informant. Moreover, petitioners are in jail custody since 20.02.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rosera in connection with Bibhutipur P.S.Case No. 240 of 2015.
