JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-05-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioner as well as the learned Special Public Prosecutor for the Vigilance, Mr. Rana Vikram Singh.

The petitioner apprehends her arrest in connection with Fatehpur P.S. Case No. 125 of 2020 registered for offence punishable under sections 420, 467, 468, 471 and 120 (B) of the Indian Penal Code.

As per allegation, the petitioner became successful in securing her appointment as Panchayat Teacher by producing

Patna High Court CR. MISC. No.14853 of 2021(7) dt.11-05-2022 2/3 forged documents by tampering her BETET mark-sheet. The petitioner, as per allegation, by manipulation, changed her category and serial number.

The learned counsel for the petitioner has submitted that on similar ground some accused persons have been granted anticipatory bail by the coordinate Benches of this Court. The learned Special Public Prosecutor for the Vigilance has submitted that some co-accused persons have been granted anticipatory bail on the ground that they shall not claim their entitlement for the post of Panchayat Teacher and they shall return the entire amount, which has been drawn by them as salary.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of her arrest or surrender, within six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Fatehpur P.S. Case No. 125 of 2020, subject to condition as laid down under section 438(2) Cr. P.C. Further condition is that the petitioner shall return the entire amount drawn by her as salary in eighteen equal monthly installments and she shall not claim

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
