2. In the present case, the petitioner seeks bail in connection with Jamalpur P.S. Case No. 224 of 2024, registered for the offences under Sections 316(2), 318(4), 3(5) of the B.N.S.
3. As per the prosecution case, petitioner and coaccused persons through their company cheated a large number of people huge amount of money giving inducement of handsome payment.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and there is no specific allegation against the petitioner. Petitioner is a freelance software engineer
Patna High Court CR. MISC. No.5451 of 2025(4) dt.12-05-2025 2/3 who was engaged by co-accused Jitendra Kumar Rajiv for preparation of software and maintenance of the website of the company. The petitioner did not receive any money from any person and has no involvement in day to day working of the company. Further the petitioner has no concern with the general public and amount deposited by them and also the withdrawal made by the company. Learned counsel further submits that due to lack of payment, the petitioner left the maintenance work of the company. On vague allegation, the present case has been lodged against the petitioner who is in custody since 19.11.2024 and he has no criminal antecedent. Charge sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner. Learned A.P.P. submits that witnesses examined during investigation have also named this petitioner who impressed upon them for depositing of money and also about the return from such money.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the non-specific nature of allegation against the petitioner and also considering his clean antecedent, period of custody and submission of charge sheet, the petitioner is directed to be

No.5451 of 2025(4) dt.12-05-2025 3/3 released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger/concerned court, in connection with Jamalpur P.S. Case No. 224 of 2024, subject to the condition laid down under Section 480(3) of the B.N.S.S. and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
