JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of C.L.A. Act.

The present case was lodged against unknown persons but subsequently, petitioner was remanded in this case on the basis of confessional statement of co-accused and except the confessional statement as well as some criminal antecedent of the petitioner, there appears to be nothing against the petitioner, who is languishing in jail custody since 11.01.2016 but up till now, has not been put on Test Identification Parade.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.15417 of 2016 (2) dt.18-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Sheohar in connection with Purnahiya P.S. Case No. 38 of 2015.
