JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in confessional statement of Kanahia Kumar and two stolen metal lights are said to have been recovered from the house of the petitioner but submission on behalf of the petitioner is that even if the aforesaid recovery is assumed to be true, then also, petitioner appears to be a bona fide purchaser.
Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties
Patna High Court Cr.Misc. No.15561 of 2016 (2) dt.19-04-2016 2/2 of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna in connection with Budha colony P.S.case No. 59 of 2016.
