JUSTICE RAJIV ROY ORAL ORDER 16-04-2025 Heard Mr. Rajeev Kumar Singh, learned counsel for the petitioners in both the cases, Mr. Dhurjati Kumar Prasad representing the State as also Mr. Manoranjan Kumar for respondent no. 6 in CWJC No. 8294 of 2017.

2. The present application has been preferred for the following relief(s):

(i) for quashing/ setting aside the common order dated 13.01.2017 passed in BLT case no. 1507 of 2015 by Hon'ble Chairman, The Bihar Land Tribunal, Patna whereby and whereunder she has dismissed the BLT case no.1507 of 2015;

(ii) for setting aside the order dated 15.09.2012 passed by Additional collector Kaimur at Bhabhua in Mutation Revision case no. 12/2012-2013 whereby and where under he has allowed the aforesaid revision case after setting aside the order dated 18.05.2012 passed in mutation Appeal No.- 66 of 2011-12 passed by D.C.L.R. Bhabhua;

(iii) for upholding the order dated 18.05.2012 passed by D.C.L.R. Bhabhua in Mutation Appeal No-66 of 2011-12;

3. Learned counsel for the petitioner submits that though he has a case, shall be pursuing the Title Suit no. 358 of

Patna High Court CWJC No.7601 of 2017(7) dt.16-04-2025 3/3 2012 (Anjani Kumar Singh Vs. Raghvendra Singh and Ors.) pending before the learned Sub Judge-I, Kaimur at Bhabhua.

4. Learned State Counsel, Mr. Dhurjati Kumar Prasad submits that the Tribunal has rightly observed that any order that will come from the Title Court, the fate of the parties shall be decided accordingly.

5. Without commenting on the merit of the case and granting liberty to withdraw the petition, the writ petition stands disposed of.
