The petitioner seeks quashing of the order dated 05.10.2020 passed in G.R. No.4736 of 2016 arising out of Hajipur Sadar P. S. Case No.451 of 2016 passed by the learned Additional Chief Judicial Magistrate-XVI, Vaishali at Hajipur whereby and whereunder the learned Court below has rejected the application of the petitioner under Section 239 of the Cr.P.C. The learned counsel for the petitioner submits that based on a mechanical investigation conducted by the police, charge-sheet came to be filed, based on which cognizance was taken and thereafter the petitioner had moved an application for

Patna High Court CR. MISC. No.14974 of 2021(2) dt.28-04-2022 2/2 discharge, but the same was also dismissed in a mechanical manner.

At this stage, the learned counsel for the petitioner seeks permission to withdraw the present quashing application. Permission is accorded.

Accordingly, instant petition is dismissed as withdrawn.
