Petitioner is not named in the first information report and it appears that his name came in this case in the confessional statement of co-accused Saroj Rai. Furthermore, it appears that co-accused Saroj Rai confessed only to this extent that he used to stay at the house of the petitioner and after occurrence, he had visited the house of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S.
