The petitioner is accused in connection with Town P.S. Case No.829 of 2018 registered under Sections 302,120B of the IPC and 27 of the Arms Act.

The accusation is that on 18.11.2018 Santosh Kumar Singh husband of informant Kavita Singh moved from house boarding on motorcycle saying that he has been called by Vijay Baba of Samta Colony and he will return soon. Vijay Baba had taken loan of rupees four lakhs some day before. After one hour she came to know that her husband was seen moving on motorcycle near Gandak bridge with Vijay Baba who was also on Honda Shine motorcycle on which Pintu Singh was sitting.

Patna High Court CR. MISC. No.3410 of 2020(2) dt.21-01-2020 2/2 Pintu Singh had also taken rupees ten lacs for marriage of his sister. In the evening informant came to know that Pintu Singh (petitioner), Vijay Baba and two unknown committed the murder of her husband Santosh Singh near Gandak bridge and the police has taken the dead body at Sadar hospital then informant went there and identified the dead body of her husband.

Learned counsel for the petitioner submits it would appear from FIR that deceased was accompanied by the coaccused and the petitioner was not with them but on mere suspicion the informant disclosed the name of petitioner and the petitioner is in custody since 08.11.2019.

Having regard to the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Vaishali at Hajipur in connection with Town P.S. Case No.829 of 2018.
