Petitioner seeks bail in Piro P.S. Case No.122 of 2018 (Excise Case No.662 of 2018) instituted for the offence under Section(s) 30(a), 47 of Bihar Prohibition and Excise Act, 2016. Counsel for the petitioner submits that there is no recovery from conscious possession of the petitioner. From the seizure list, it will appear that recovery has been made from Khalihaan of Asgun Yadav and also from the Bolero Car, which was standing in front of Khalihaan. Petitioner is said to have been seen running away from the place of occurrence. He has been arrested merely on suspicion.

Petitioner is in custody since 15.10.2018.

In the facts and circumstances of the case, prayer of

Patna High Court Cr.Misc. No.4862 of 2019(2) dt.06-02-2019 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Bhojpur, Ara, in connection with Piro P.S. Case No.122 of 2018 (Excise Case No.662 of 2018), subject to the condition that both the bailors shall be close relative of the petitioner. It appears that two cases under the Excise Act are pending against the petitioner. The petitioner will file an Affidavit at the time of his release that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will be liable to be cancelled.
