JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 18-05-2015 Heard learned counsel for the petitioners and the State. The petitioners are accused in connection with Baniapur P.S. Case No. 64/2014 registered under sections 341,323,324,379,504 and 506/34 IPC.

As per the allegation, while the informant with his brother and sister were sitting outside the house, the co-accused Sajan Rai started hurling abuses on seeing the sister of the informant. On the objection being raised by the brother of the informant, all the accused persons started assaulting the sister and the brother of the informant. Petitioner no.2 is said to have assaulted the informant on his head with iron rod, whereas petitioner no.1 is alleged to have assaulted the sister of the informant.

Counsel for the petitioners draws attention of the Court to the injury report wherefrom it appears that the informant received one sharp-cut injury which was opined to be simple in

Patna High Court Cr.Misc. No.10608 of 2015 (3) dt.18-05-2015 2 / 2 nature. Rekha Kumari, sister of the informant received sharp cut inquiry on the right side of her head which was found to be simple in nature. It has been submitted that the petitioners have no murky past and this is the first time they are facing such criminal accusation.

In the facts and circumstances of the case, the petitioners abovenamed are directed to be released on bail on furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in Baniapur P.S. Case No. 64/2014 on condition that one of the bailors of each of the petitioners shall be own/close family members. In the event of framing of charge the petitioners shall appear in person on each date fixed at the trial. Failure in appearance on two consecutive dates shall lead to cancellation of his bail bonds. Furthermore, if during the subsistency of this privilege the petitioners are found involved in any criminal case, the same shall be construed as breach of conditions of bail entailing cancellation thereof.
