JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was in jail at the time of alleged occurrence and it is alleged that he along with several persons created hurdle in shifting of some co-accused from one jail to another and in that course, the petitioner and others made attack on the police party and also ransacked jail property.

Submission on behalf of the petitioner is that having more or less similar allegation, several co-accused have already been granted privilege of bail by different Benches of this Court. No doubt, petitioner carries criminal antecedent of several cases but in the present case, he is in jail custody since

Patna High Court Cr.Misc. No.16233 of 2016 (2) dt.22-04-2016 2/2 07.08.2015 and some co-accused having similar allegation, have already been granted privilege of bail.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S.Case No. 285 of 2014.
