JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. One country made loaded pistol and two live cartridges are said to have been recovered from conscious possession of the petitioner and so far as seized motorcycle is concerned, the submission on behalf of the petitioner is that the aforesaid motorcycle was purchased by the petitioner and, as a matter of fact, the petitioner is owner of the aforesaid motorcycle. It is submitted that prior to institution of the present case, the wife of the petitioner filed Complaint Case No. 607 of 2012 for the offence punishable under section 323 and 324 of the Indian Penal Code against the petitioner and the father of the wife of the petitioner managed the police and got instituted this false case.
