The anticipatory bail of the petitioner, earlier, was withdrawn by the learned counsel for the petitioner as is evident from the order dated 28.11.2022 in Cr. Misc. No. 34955 of 2022.
Learned counsel for the petitioner submits that certain relevant facts which were existing when the aforesaid anticipatory bail application was filed could not be brought on record necessitating the filing of the present anticipatory bail application.
Learned A.P.P. for the State opposes the second
Patna High Court CR. MISC. No.15327 of 2023(2) dt.05-04-2023 2/2 anticipatory bail application on the ground that no subsequent fact is being heard and the anticipatory bail application was permitted to be withdrawn by order dated 28.11.2022 in Cr. Misc. No. 34955 of 2022 and more than three months, thereafter, the present anticipatory bail application has been filed.
Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to entertain the present anticipatory bail application and thus is rejected. (Satyavrat Verma, J) HarshPandey/- U T
