Petitioner apprehends arrest in a case registered for the offence punishable under section 272, 273, 414, 34 of the Indian Penal Code and 30(a), 36, 41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

As per the prosecution case, 6.750 liter of foreign liquor recovered from Scorpio vehicle.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Name of the petitioner has come in the case on the confessional statement of co-accused. No incriminating material has been recovered from conscious possession of the petitioner. Learned counsel for the State opposes the prayer for

Patna High Court CR. MISC. No.4994 of 2023(2) dt.07-04-2023 2/2 bail. He submits that the petitioner has got 5 criminal antecedents of similar nature.

Considering the fact that the petitioner has got criminal antecedents of similar nature his prayer for bail is rejected.
