JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is in custody in connection with Nawada Town (Kadirganj) P.S.Case No.677 of 2015 registered for an offence under Sections 147, 148, 149, 341, 323, 324, 307, 448 and 302/34 of the IPC.

Prosecution case, in short, is that on 21.10.2015 at about 9.30 A.M. all the accused persons including the petitioners have iron-rod, lathi, Chhura and brick-stones came at the house of the informant and started assaulting due to which the deceased father Ram Kishun Chaudhary and the informant sustained grievous injury and when the informant's mother Malo Devi, sister Sushila Devi and brothers Ajay Chaudhary all were also

Patna High Court Cr.Misc. No.15641 of 2016 (45) dt.22-07-2016 assaulted the informant's family. The informant's father was carried to PMCH for better treatment where he died on 22.10.2015.

Petitioner is in custody since 01.12.2015. Chargesheet has been submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. It is case and counter case between the parties. No specific injury has been attributed against the petitioner. General and omnibus allegation has been made against the petitioner.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Nawada in connection with Nawada Town (Kadirganj) P.S.Case No. 677 of 2015.
