JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This application has been filed for cancellation of anticipatory bail granted to opposite party Nos. 2 and 3 by learned Sessions Judge, Gaya, in A.B.P. No. 3081 of 2018 vide order dated 25.8.2018.

Main contention of learned counsel for the petitioner is that opposite party Nos. 2 and 3 have criminal antecedents and by suppressing the material fact they have been granted bail.

Heard learned APP also.

Having heard both sides and perused the impugned order from which it appears that learned Sessions Judge has granted bail to opposite party Nos. 2 and 3 on merit considering

Patna High Court Cr.Misc. No.4233 of 2019(2) dt.29-01-2019 2/2 the fact that invoice has been approved by the BDO and then payment has been made to the suppliers.

In such view of the matter, I am not inclined to interfere with the impugned order.

Accordingly, this application is dismissed.
