The petitioner is in custody in a case registered under Sections 420, 467, 468, 471, 406 and 120(B) of the Indian Penal Code.

The informant is the Senior Branch Manager, Bank of India, Anisabad Branch. It is alleged that on 28.06 2014, a current A/C in the name of M/s Relax Tour Package was opened which is proprietary concern. The name of its Proprietor is Yashwardhan, who withdrew the money presenting false cheque in the branch. On 19.9.2014, Rs. 2,72,100/- and on 22.9.2014 Rs. 4,80,600/- were withdrawn by him by way of cheating. Thereafter, search was made on his address and phone but no avail.

Patna High Court Cr.Misc. No.24010 of 2015 (2) dt.06-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case due to mistake of fact. It is further submitted that the petitioner is not named in the FIR. The allegation in the FIR has been made against one Yash Vardhan. It is also submitted that no incriminating article has been recovered from the possession of the petitioner nor the petitioner has been put on T.I. parade. The petitioner is in custody since 28.10.2014. Learned counsel for the petitioner has submitted that the petitioner may be released after completion of one year in custody.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the facts aforesaid, the above named petitioner is directed to be released on bail, after completion of one year in custody from 28.10.2014, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, V , Judicial magistrate, 1st Class, Patna in Gardanibagh P.S.Case No. 341 of 2014.
