JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 173 P.S.Case No. 250 of 2018 registered for the offence under Section 30(a) of Bihar State Prohibition and Excise Act.
Allegation is of recovery of 143 litres of foreign liquor from a lodge owned by the petitioner.
Submission of learned counsel for the petitioner is that prosecution case itself shows that recovery has been made from room of the lodge where the students are residing and petitioner has falsely been implicated in this case, having no criminal antecedent.

Having heard both sides and in the facts and
Patna High Court CR. MISC. No.4931 of 2019(3) dt.12-03-2019 2/2 circumstances, let petitioner, above named, be released on bail in the event of his arrest or surrender in the court below within a period of six weeks from the receipt of this order, on furnishing bail bond of Rs 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani, in connection with G.O. Case No. 173 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
