Heard learned counsel for the petitioners.
At the outset, it has been submitted that petitioner No. 2, Ram Sari Devi, has been arrested during pendency of this petition.
As such, the anticipatory bail petition in her respect is dismissed as withdrawn.
The petitioner No.1 Anil Singh, apprehends his arrest in connection with Maner P.S. Case No. 165 of 2020, registered for the offences punishable under Sections 304(B)/34 of the
Patna High Court CR. MISC. No.15861 of 2021(2) dt.18-01-2022 2/3 Indian Penal Code and 3/4 Dowry Prohibition Act. Petitioner No. 1, Anil Singh is father-in-law of the deceased, Manisha Devi. The father of the deceased Manisha Devi is the informant. He lodged the FIR with allegation that the marriage of his daughter was solemnized two years before. The customary presents were given on the occasion of the marriage as per affording capacity of the informant but the matrimonial inmates were not satisfied and they used to torture and assault the deceased. On 19.03.2020 the informant got information from his younger son-in-law that all the four accused persons named in the FIR including the present petitioner had strangulated the deceased to death by wrapping gamacha around her throat.
Learned counsel for the petitioner has submitted that there is explicit allegation of dowry demand in the FIR but the amount of dowry has not been mentioned. He has also submitted that the petitioner is father-in-law and the allegation is general and omnibus in nature.
The deceased died in her matrimonial house in suspicion circumstances within two years of her marriage and there is specific allegation of infliction of atrocities for nonfulfillment of dowry demand against all the accused persons

In my view, it is not a fit case for anticipatory bail. Accordingly, the prayer for anticipatory bail of petitioner No. 1 is hereby rejected.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
