The petitioner is in custody in a case registered under Sections 341, 323, 324, 307, 376, 448, 504 and 34 of the Indian Penal Code.
The prosecution case in, brief, is that as per FIR, it is alleged that this petitioner established sexual relation with the daughter of the informant in the pretext of marriage and when the informant told to perform marriage with her daughter, they refused. It is further alleged that when the daughter of the informant was alone in her room, the petitioner along with other tried to kill the daughter of the informant by sprinkling K.Oil upon her.
Patna High Court Cr.Misc. No.23960 of 2015 (2) dt.06-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. Further it is submitted that the present case has been instituted after three days of the occurrence and no explanation has been made on behalf of the prosecution. It is further submitted that Annexure 2 is the injury report, which indicates that the injuries are simple in nature. Further it is submitted that other co-accused persons have been granted bail, vide Annexure 3.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Darbhanga in Bishanpur P.S.Case No. 83 of 2014.
