JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-414/120(B) of the Indian Penal Code. Two persons were arrested and disclosed that the petitioner and one Anil Rai used to give space in their respective houses for keeping stolen motorcycles and after that, house of the petitioner was raided and one stolen motorcycle was recovered from his house in his absence.
Learned counsel for the petitioner submits that having similar allegation, one co-accused namely, Anil Rai has already been granted privilege of bail by a coordinate bench of this court and so far as criminal antecedent of the petitioner is
Patna High Court Cr.Misc. No.15991 of 2016 (2) dt.21-04-2016 2/2 concerned; earlier only one case i. e. Lalganj P.S. Case No. 50 of 2015 for the offences of Arms Act, had been lodged against the petitioner.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Lalganj P.S. Case No. 51 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
