The petitioner has renewed his prayer for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 170 litres of liquor was recovered from the car and the petitioner was taken into custody. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 13.8.2021 (Annexure-P/1) passed in Cr. Misc. No. 16991 of 2021 giving liberty to the petitioner to renew his prayer for bail after completing one year in custody. The petitioner is in custody since 28.11.2020.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the liberty granted in the aforesaid order of rejection dated 13.8.2021 and the petitioner having remained in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Sabour (Goradih) P.S. Case no. 269 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge II - cum - Special Judge, Excise Act, Bhagalpur.
