The petitioner is in custody in a case registered under Sections 413, 414. 420/34 of the Indian Penal Code. The prosecution case in, brief, is that the informant claimed that on 12.03.2015 at about 11 A.M. when he along with other police officials was on patrolling, he got information that near Bharat Seva Ashram, Gaya, a thief of motorcycle has been cought by the public and physically assaulted by the public. The informant reached there and found a person assaulting by the public. The informant further claimed that he taken the said boy in his custody and asked his name, who disclosed his name as Uday Kumar @ Tempu. It is further alleged
Patna High Court Cr.Misc. No.23976 of 2015 (2) dt.06-07-2015 2/2 that upon the statement of the petitioner, the police raided at several houses, where several motorcycles were recovered without any valid document.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. Further it has been submitted that the petitioner has no concern with the stolen motorcycles. The petitioner is in custody since 12.03.2015. It is submitted that the petitioner may be released, after completion of six months in custody.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, the above named petitioner is directed to be released on bail, after completion of six months in custody from 12.03.2015, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya, in Civil Lines P.S.Case No. 112 of 2015.
