The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code against eight unknown.

As per allegations in the F.I.R., the accused persons on a motorcycle looted the maize crops loaded on the tractor while the informant was on way to the market. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in the confessional statement of co-accused Brajesh Kumar and Ajay Kumar Das made before police. No incriminating article has been recovered from the possession of the petitioner and the said Brajesh Kumar has been enlarged on

Patna High Court CR. MISC. No.15862 of 2021(2) dt.13-08-2021 2/2 bail vide order dated 12.2.2021 passed in Cr. Misc. no.38295 of 2020. The petitioner is in custody since 26.11.2020 and has no criminal antecedent. He has not been put on T.I. parade and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the facts of the case including grant of bail to co-accused together with the petitioner not having been put on T.I. parade and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Barhara P.S. Case no.152 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Purnea.
