2. The petitioner seeks regular bail in connection with Fatehpur P.S. Case No. 613/2023 lodged on 17.08.2023 under Section 366A of the Indian Penal Code.

3. As per the prosecution case, the present FIR has been lodged against the petitioner alleging therein that the petitioner has abducted the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. On recovery, the victim got her statement recorded under Section 164 of the Cr. P.C. wherein her aged has been identified as 18 years and the victim has disclosed that she went in the company of the petitioner with her own and no force has been imposed

Patna High Court CR. MISC. No.9015 of 2024(2) dt.20-02-2024 2/2 upon her by the petitioner. The petitioner is in custody since 18.08.2023 having no criminal antecedent and the chargesheet has already been filed.

5. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Courtcum-Add. District and Sessions -VI, Gaya, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure.
