Petitioner seeks bail in a case registered under sections 25 (I-B) A, 26 of the Arms Act as well as section 3/ 4 of the Explosive Substance Act.

The informant, having got confidential information, raided the house of the petitioner and one country made rifle was recovered from frontal verandah of the petitioner whereas four live cartridges were found inside the house lying on a table. Furthermore, one bomb was recovered in front of house of the petitioner. Submission on behalf of the petitioner is that the aforesaid recovery has not been made from conscious possession of the petitioner and, as a matter of fact, there was inimical term of the petitioner with his brother who got planted this case after taking police in his collusion.

Moreover, petitioner does not have any criminal antecedent

Patna High Court Cr.Misc. No.15451 of 2016 (2) dt.18-04-2016 and is languishing in jail custody since 5.1.2016. Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jamui in Khaira P.S. Case no. 02/2016.
